These Terms of Service ("Terms") govern your access to and use of the DEXY website, the waitlist, and any related services (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who we are
The Service is provided by Dexy App Pty Ltd (ACN 698 672 374), an Australian company ("DEXY", "we", "us", or "our"). You can contact us at legal@dexyapp.ai.
2. The Service
DEXY is a proptech intelligence platform that reads and scores property listings against a brief you set. The Service is currently in a pre-launch phase, and access is offered in stages via a waitlist. Features, scoring, pricing, and availability may change, and parts of the Service may be unavailable, incomplete, or offered for evaluation.
3. Not financial, investment, legal, or tax advice
DEXY provides information, analysis, and a property score to help you make your own decisions. It is not financial, investment, legal, or tax advice, and it is not a recommendation to buy, sell, or hold any property. DEXY does not consider your personal financial circumstances. Property decisions carry risk, and past or projected performance is not a guarantee of future results. You should do your own research and seek advice from a licensed professional before making any property or financial decision.
4. Eligibility
You must be at least 16 years old to use the Service. By using it, you confirm that you can form a binding contract with us and that the information you provide is accurate.
5. The waitlist
Joining the waitlist registers your interest. It does not create an obligation on us to provide the Service to you, by any date, at any particular price, or at all. Any launch pricing or early-access benefit we mention is an indication, not a binding offer, and may change before launch.
6. Acceptable use
You agree not to:
- use the Service unlawfully or for any unlawful purpose;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service or its systems;
- scrape, copy, or harvest data from the Service except as expressly permitted;
- submit false, misleading, or another person's details without authorisation; or
- misuse the Service in a way that could damage, disable, or impair it.
7. Intellectual property
The Service, including its content, branding, and software, is owned by DEXY or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works without our written permission.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any score, analysis, or data is accurate, complete, or current. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by law, DEXY will not be liable for any indirect, incidental, special, or consequential loss, or any loss of profit, opportunity, or data, arising from your use of the Service. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the Service or paying the cost of doing so.
10. Changes to the Service and these Terms
We may change, suspend, or discontinue any part of the Service, and we may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia.
